While stringent federal regulations exist to prevent securities fraud, both individuals and entities continue to engage in these activities. Securities fraud occurs when someone uses untrue or misleading statements to influence the sale or purchase of stocks, bonds, mutual funds, or other investments. They might provide blatantly false information to shareholders or simply fail to disclose crucial information so investors will want to buy or sell the securities in question.

Investors who fall victim to these fraudulent schemes have the legal right under both state and federal law to seek financial recovery. Silver Law Group’s team of securities fraud attorneys, led by top investment fraud lawyer Scott Silver, possess the resources and knowledge to analyze your claim and represent you at each stage of your case. We provide insightful leadership for numerous class action claims against those who took advantage of you, no matter where in the country you live.

Recognizing the Common Forms of Securities Fraud

Securities fraud occurs when an individual or entity, such as brokerage firms, brokers, financial advisors, lawyers, or commercial banks, use deceptive means to cheat investors out of profits from their investments or fail to properly warn investors about investment risks. Silver Law Group is well-equipped to investigate, and file claims, against various forms of securities fraud, including claims of corporate misconduct, omissions, misrepresentations, unauthorized trading, and Ponzi schemes.

Ponzi Schemes

Ponzi schemes are one of the most infamous types of investment fraud. Ponzi scheme operators will usually entice investors to invest in a venture with the promise of high or consistent returns, and a very low level of risk. However, the Ponzi scheme uses new investor money to pay old investors. When investors put cash into a Ponzi scheme, they are not investing in a legitimate business venture. To disguise the fact that the business is not real, the fraudster will continue to attract new investors to pay off the old ones, which creates a false pretense that real returns are being generated. That cash flow eventually runs out as word-of-mouth spreads and the scheme falls apart.

However, it can be years before this happens, and by that point, investors may have lost millions. Ponzi schemes can take many forms, including fraudulent trading accounts, real estate frauds, cryptocurrency scams and others. If you are the victim of a Ponzi scheme, or aware of any current Ponzi schemes, please contact Silver Law Group immediately to have a one-on-one consultation with one of our securities fraud experts.

Securities Fraud Litigation Options

Silver Law Group can evaluate your claim to determine the appropriate charges to file and the most effective legal option to pursue your case. In any instance of suspected securities fraud, you should take care to preserve all evidence related to your potential claim, like account statements or copies of your communications with the alleged perpetrators.

Class Actions

One potential option is securities class actions. Securities class actions are a litigation option that allow large groups of investors who have been harmed by the same party to seek legal recovery. Investors with wide-ranging losses can join a class action, which means even if they may not qualify to file an individual claim, they could still recover their economic losses if the class action succeeds.

A securities fraud class action lawsuit consolidates claims into a single case which means it generally files in federal district court. This can save on court costs and reduce the wait time plaintiffs would otherwise endure if each case was heard individually. Please see our list of active securities class action claims, which is constantly updated with the latest breaking news.
