The case, filed in August 2025 in federal court, claims that thousands of investors were misled into believing their money was funding ATM operations when in fact it was used to cover shortfalls and enrich insiders.

The complaint alleges an $80 million Ponzi scheme, in which funds were raised through unregistered offerings and investor money was misrepresented and misused.

The lawsuit seeks to recover losses for affected investors nationwide. No class has been certified, and the court has not ruled on the merits of the allegations.
